Customer notice and general terms and conditions of ConnectHearing, Inc. (hereinafter “ConnectHearing”)
1. Covered Area
These terms and conditions (“T&Cs”) apply to all sales of Phonak Audéo PFE headphones through ConnectHearing, Inc. with customers in the United States where such sales are made via the internet. The T&Cs do not apply to contracts between any affiliate of Sonova Holding AG and its business partners. Any provisions which differ from these T&Cs are valid only with our prior confirmation in writing. We retain the right to add to, amend, or remove these T&Cs at any time.
2. Contracting parties

3. Conclusion of the contract
3.1 An order placed on the website constitutes a binding offer to enter into a contract with ConnectHearing. We reserve the right either to accept such offers or to decline them in either case within 7 days of receipt of your order. A binding sales contract for the goods ordered will only come into force once we have accepted your order. If we accept your order we will send you an order confirmation by e-mail.
3.2 The details and shipping conditions of your order are subject to the conditions chosen by you on the web site. The contract will be subject to the conditions applicable to the offer concerned (product features, price, shipping costs and additional charges).
4. Price and additional charges
4.1 For The total price of your order, including shipping and applicable sales tax and other charges, will be quoted to you when you submit your order on our web site, when we confirm receipt of your order on the website, and when we send you e-mail confirmation of your order.
4.2 Prices are given in US dollars.
5. Payment terms
Goods are supplied only after payment via the accepted payment methods Visa or, for customers with domicile and with delivery addresses in the United States.
6.1 The goods ordered will be shipped according to the delivery method selected using a third-party that we will select, usually within 1 working days of the day following your order, to the delivery address specified by you. Delivery dates are binding only where confirmed as such by us in writing.
6.2 Risk and responsibility on the goods pass to you at the time when the goods are provided to the third-party carrier.
6.3 We ship only within the United States and do not offer international shipping.
6.4 You will be invoiced for charges for the return of goods in cases where an incorrect or incomplete address has been given, or where you have refused to accept delivery.
7. Cancellation of Contract and Returns
7.1 In case the purchased goods do not meet your expectation, you may return them within 14 days from the date of receipt, stating the reasons why you are not satisfied, for a refund of the purchase price. In this case, please fill out a Returns Request Form or contact email@example.com.
For the return, ship the goods to us together with all accessories including the original packaging. Please attach your proof of payment. Returning the goods is at your expense and risk.
7.2 We will inspect all goods returned to us. Products that have been purchased must be returned with all their accessories and original packaging and must be in mint condition. We will refuse a return if:
- the product is returned without its original packaging; or
- the product and accessories are not in resalable condition.
8. Retention of title
The goods remain our property until the purchase price and associated costs have been paid in full.
9. ConnectHearing limited warranty
9.1 As distributor, ConnectHearing provides a limited warranty on the purchased products. The terms of the warranty are listed under item 6 of the Instructions for Use booklet inside the product packaging. Item 6 of the Instructions for Use booklet alone defines the duration, scope and terms of the warranty. ConnectHearing is exclusively responsible for the compliance with the warranty.
9.2 In the event of a claim under warranty, you must send us an email at firstname.lastname@example.org to obtain a Return Merchandise Authorization (“RMA”). Once approved and authorized, you must then send the product at your expense and risk to the address given under section 2 of these T&Cs, stating the defects for which you claim warranty. ConnectHearing will then deal with your warranty claim in accordance with item 6 of the Instructions for Use.

10. Limitation of Warranty
10.1 Item 2 of the Instructions for Use supplied with the Audéo PFE headphones gives detailed information on the risk of hearing damage resulting from the use of the headphones. Please read this section and follow its recommendations. ConnectHearing is not liable for any damage arising from any breach of these recommendations.
10.2 TO THE EXTENT ALLOWED BY LOCAL LAW, NEITHER CONNECTHEARING NOR ANY RELATED THIRD PARTY MAKES ANY OTHER WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE.
11. Limitation of Liability
11.1 To the extent allowed by local law, the remedies provided in this Limited Warranty Statement are the customer’s sole and exclusive remedies.
11.2 TO THE EXTENT ALLOWED BY LOCAL LAW, EXCEPT FOR THE OBLIGATIONS SPECIFICALLY SET FORTH IN THIS WARRANTY STATEMENT, IN NO EVENT WILL CONNECTHEARING OR ANY RELATED THIRD PARTY BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Prohibition of assignment
You may not assign your legal rights to third parties without our approval in writing.
13. Intellectual property protection
The entire contents of this web site are protected by copyright. Individual pages and/or sections may be saved or printed provided that the copyright symbols and other protected marks are not removed. The saving or reproduction of software or other data on this web site implies acceptance of the relevant conditions of use. ConnectHearing retains all proprietary rights. This web site may not be reproduced (in full or in part), transmitted (electronically or by other means), modified, linked to, or used for public or commercial purposes without the prior written consent of ConnectHearing.
14. General Provisions
14.1 Should individual provisions of these T&Cs be invalid in full or in part, this does not affect the validity of the remaining provisions. The wholly or partly ineffective provisions will be replaced by others, the content of which most closely approaches that of the ones that have become ineffective.
14.2 These T&Cs and contracts entered under the T&Cs are subject to the provisions of the laws of the State of Tennessee
14.3 This Limited Warranty Statement gives the customer specific legal rights. The customer may also have other rights which vary from state to state in the United States.
14.4 To the extent that this Limited Warranty Statement is inconsistent with local law, this Statement will be deemed modified to be consistent with such local law. Under such local law, certain disclaimers and limitations of this Warranty Statement may not apply to the customer. For example, some states in the United States may: (i) preclude the disclaimers and limitations in this Warranty Statement from limiting the statutory rights of a consumer; (ii) otherwise restrict the ability of a manufacturer to enforce such disclaimers or limitations; or (iii) grant the customer additional warranty rights, specify the duration of implied warranties which the manufacturer cannot disclaim, or allow limitations on the duration of implied warranties.
THE TERMS IN THIS WARRANTY STATEMENT, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT, OR MODIFY, AND ARE IN ADDITION TO, THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THE PRODUCT TO SUCH CUSTOMERS.
